These standard terms and conditions form the entire agreement between SKS Shop and the Customer regarding
the subject matter hereof. No alteration or variation shall be of any force or effect unless such change
is reduced to writing and signed by both parties. All provisions and clauses of this contract are severable
from each other. Any provision or clause of this contract which becomes unenforceable due to voidness, invalidity, illegality,
unlawfulness or for any other reason whatsoever, shall to the extent that it is so unenforceable, be treated as not forming part
of the contract. The remaining provisions and clauses of this contract shall remain of full force and effect.
1. Scope :
These Terms and Conditions ("Terms") govern the sale and purchase of custom-designed desks, chairs, and related accessories by SKS Shop ("Seller") to you, the customer ("Buyer").
2. Orders and Acceptance :
- Orders : Orders are to be submitted through our e-commerce platform for domestic purchases. For international customers, quote requests should be submitted, including detailed specifications for the desired products.
- Acceptance : Seller reserves the right to accept or reject any order at its sole discretion. Acceptance will be confirmed in writing with a final quote outlining the Products, pricing, and estimated delivery timeframe.
3. Pricing and Payment
- Pricing : Prices quoted are for custom-designed Products and may vary based on materials, features, and complexity.
- Payment Terms : Payment is 100% upfront unless the Buyer uses BNPL. For BNPL, delivery and installation will proceed after the first payment.
- Payment Methods : We accept credit card, debit card, BNPL & Online Bank In via our payment gate-away.
4. Delivery and Installation
- Delivery : Delivery timelines are estimates and may be subject to change. Buyer is responsible for arranging access to the delivery location and any associated fees.
- Installation : Installation: Installation is included with the purchase, except for international customers.
5. Inspection and Acceptance
- Inspection : Buyer is responsible for inspecting the Products upon delivery for any damage or discrepancies.
- Acceptance : The customer's confirmation of the purchase online constitutes acknowledgment that the products comply with the order specifications.
6. Warranties
- Limited Warranty : Seller warrants that the Products will be free from defects in materials and workmanship for a period of [warranty period, e.g., 1 year] from the date of purchase. This warranty covers repairs or replacements of defective parts at Seller's discretion.
- Warranty Exclusions : The warranty does not cover normal wear and tear, misuse, improper assembly, modifications, or damage caused by factors beyond Seller's control.
7. Returns and Cancellations
- Custom Orders : Due to the custom nature of the Products, returns and cancellations are generally not accepted. However, Seller may consider requests on a case-by-case basis.
- Standard Products : The return policy for any standard accessories included with the purchase.
8. Limitation of Liability
Seller's liability under these Terms is limited to the purchase price of the Products. Seller shall not be liable for any indirect, incidental, consequential, or special damages arising from the sale or use of the Products.
9. Intellectual Property
Seller retains all intellectual property rights in the design and functionality of the Products.
10. Entire Agreement
These Terms constitute the entire agreement between Seller and Buyer regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements.
